5. User Content and Data
You retain ownership of the health data and content you provide through our Services ("User Content"). By using our Services, you grant Distal a limited license to:
- Store, process, and display your User Content to provide Services
- Share your data with authorized caregivers and healthcare providers
- Generate anonymized, aggregate analytics to improve our Services
You are responsible for ensuring your User Content is accurate and does not violate any laws or third-party rights.
6. Prohibited Uses
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Services or servers
- Upload malicious code or content
- Impersonate any person or entity
- Use the Services to transmit spam or unsolicited communications

You may not copy, modify, distribute, sell, or lease any part of our Services without prior written consent. The Distal name, logo, and all related names and logos are trademarks of Distal Health, Inc.
8. Termination
We may terminate or suspend your access to the Services:
- For violations of these Terms
- At our discretion with reasonable notice
- Immediately for serious violations or illegal activity
Upon termination, your right to use the Services ceases immediately. You may request an export of your data within 30 days of termination.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Distal shall not be liable for indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid for Services in the preceding 12 months
- We are not liable for actions or omissions of healthcare providers using our platform
- We are not liable for service interruptions beyond our reasonable control
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that you may bring claims in small claims court if eligible.
You agree to waive any right to a jury trial and to participate in class action lawsuits against Distal.
